Welcome to davidji inc., the online and mobile service of davidji inc. and the davidji Meditation Academy (“davidji inc.,” “we,” or “us”). Our Privacy Policy explains how we collect, use, disclose, and protect information that applies to our Service, and your choices about the collection and use of your information. Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in our Terms of Use. If you do not agree with this Privacy Policy in general or any part of it, you should not use our online or mobile services.

We collect the following types of information about you:

(a) Information you provide us directly

We may ask for certain information such as a username, your first and last names, birthdate, phone number, profession and e-mail address when you register for a davidji inc. account, or if you correspond with us. We also collect any messages you send us through the Service, and may collect information you provide in User Content you post to the Service (such as in comments you make on the blog). We use this information to operate, maintain, and provide the features and functionality of the Service to you, to correspond with you, and to address any issues you raise about the Service.

You may also unlink your third party account from the Service by adjusting your settings on the third party service. If you unlink your third party account, we will no longer receive information collected about you in connection with that service.

We will directly collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information (in respect of which, please see the paragraph on log file information below) that assists us in improving the Service. (d) Cookies information and information taken from similar technologies

(e) Log file information

Log file information is automatically reported by your browser or mobile device each time you access the Service. When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information.

Summary: Whenever you load a page from davidji inc., your browser sends us info about itself and your interactions with our Service. That info gets stored on our servers.

(g) Device identifiers

When you access the Service by or through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by davidji inc.. A device identifier may convey information to us about how you browse and use the Service. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled. Device Identifiers used by davidji inc. include the Android Advertising ID and iOS Advertising Identifier.

We use the information we collect about you for the purposes set out above which we have described in more detail below:

  • Providing you with the Service: We use the information that you provide us to provide the Service to you. This includes allowing you to log in to davidji inc., or the davidji Meditation Academy, operating and maintaining the Service, giving you access to your online dashboard, online courses, curated content, and billing you for transactions that you make via the Service. We also use information we collect about you automatically to remember information about you so that you will not have to re-enter it during your visit or the next time you visit the site.
  • For data analytics: We use information about you to help us improve the davidji inc. Service and our users’ experience, including by monitoring aggregate metrics such as total number of visitors, traffic, and demographic patterns.
  • Customizing the Service for you: We use information you provide us and information about you to make sure that your use of the Service is customized to your needs. For example, what kind of emails you want to receive from davidji inc..
  • To communicate with you about the Service: We use your contact information to get in touch with you and to send communications about critical elements of the Service. For example, we may send you emails about technical issues, security alerts or administrative matters.
  • To promote and drive engagement with the davidji inc. Service: We use your contact information to get in touch with you about features and offers relating to the Service that we think you would be interested in. We also use information we collect about you to make sure that you get the most relevant offers and promotions based on your use of the Service, and your preferences.   • Customer happiness: We use information about you, information that you provide to our customer happiness team, and information about your interactions with the Service to resolve technical issues you experience with the Service, and to ensure that we can repair and improve the Service for all davidji inc. users.
  • For security measures: We use information about you to monitor activity that we think is suspicious or potentially fraudulent, and to identify violations or this Privacy Policy or our Terms of Service.
  • For matters that you have specifically consent to: From time to time davidji inc. may seek your consent to use your information for a particular purpose.   • For matters that we are required to use your information by law: davidji inc. will use or disclose your information where we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Use or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of davidji inc., our Users or others.

Legal bases for processing information under the GDPR (for users in the EEA)

For davidji inc. users in the European Economic Area (EEA) davidji inc. processes your information in accordance with European laws and regulations such as the General Data Protection Regulation (GDPR). The GDPR governs how davidji inc. may process your information, and the rights that EEA users have in relation to it.

This means that davidji inc. will collect and use your information only where:

  • We need it to provide you the Service and fulfil our obligations to you under our Terms of Service.
  • It is in our legitimate interests to provide a useful Service, to send you marketing and to enhance our Service via research and development (but only where our legitimate interest isn’t overridden by your interest in protecting your data).

However, if you do so it may mean that it is not possible for you to continue using the Services.

OUR ROLE AS DATA CONTROLLER AND DATA PROCESSOR

davidji inc.  generally acts as the data controller of your information submitted through our website.

If you are situated in the EU and have any complaints regarding our privacy practices as data controller, you have the right to make a complaint at any time to your local Supervisory Authority. We would, however, appreciate the chance to deal with your concerns before you approach your Supervisory Authority so please contact us in the first instance. Please see our contact details below in the section titled “Contact Us”. If you are situated in the EU and have a complaint, please contact our privacy manager at customerservice@davidji.com.

PROVISION OF PERSONAL DATA AND FAILURE TO PROVIDE PERSONAL DATA

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with our services). In this case, we will not be able to provide services to you.

LEGAL BASIS FOR OUR PROCESSING OF YOUR PERSONAL DATA

Below are the types of lawful basis that we will rely on to process your personal data:

  • Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).   • Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
  • Comply with a legal or regulatory obligation means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject.

CHANGE OF PURPOSE

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us at customerservice@davidji.com. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

COLLECTION OF PERSONAL DATA FROM THIRD PARTY SOURCES

We also collect personal data about you from various third parties and public sources.

  • If you register for our services using Facebook, Twitter or other social media sites, we will import your information from those social media sites.
  • As discussed above, we also obtain information through automated technologies (see section titled “Information Collection”)

WITHDRAWING YOUR CONSENT

If we are relying on your consent to process your personal data, you have the right to withdraw your consent at any time. You have the right to withdraw your consent at any time by contacting us at customerservice@davidji.com.

USE OF YOUR PERSONAL DATA FOR MARKETING PURPOSES

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising:

  • Promotional offers from us: We may use your personal data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have requested information from us or used our services and, in each case, you have not opted out of receiving that marketing.
  • Third-party marketing: We will get your express opt-in consent before we share your personal data with any company outside our company for marketing purposes.

RIGHTS OF EU DATA SUBJECTS

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

OPTING OUT OF MESSAGES FROM US

To opt-out of any future promotional messages from us, you should send an unsubscribe request to us at customerservice@davidji.com. If you do not want your personal information or personal data shared with any third party who may use such information for direct marketing purposes, then you may opt-out of such disclosures by sending an email to customerservice@davidji.com. We will process your request within a reasonable time after receipt. Please note that if you opt out in this manner, certain aspects of the Website may no longer be available to you.

OPTING OUT OF COOKIES

If you want to stop or restrict the placement of cookies or flush any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. By deleting our cookies or disabling future cookies you may not be able to access certain areas or features of our Website or some of its functionality may be affected. Cookies and similar items are not used by us to automatically retrieve personally identifiable information from your device without your knowledge.

DATA RELATING TO CHILDREN

Our Website is designed for those 18 years of age and older. We do not knowingly collect information from anyone under the age of 13 (or such other age as may be restricted under local law). If we are made aware that we have received such information, or any information in violation of our policy, we will use reasonable efforts to locate and remove that information from our records.

CROSS BORDER TRANSFERS

Our website is maintained in the United States. If you are visiting from the regions with laws governing data collection and use that may differ from those in the United States, please note that you may be transferring your information to the United States and in other countries around the world. You freely and specifically give us your consent to export and use your information within the United States and in other countries as specified in this Privacy Policy. Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of personally identifiable information, such as name, email address and mailing address and the type of services provided to the customer that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) the names and addresses of all such third parties. UPDATES TO THIS PRIVACY POLICY

We reserve the right, at our discretion, to change, modify, add, or remove portions from this privacy policy at any time. However, if at any time in the future we plan to use your information in a way that materially differs from this privacy policy, we will post such changes here or email you. We encourage you to periodically review the website for the latest information on our privacy practices. Subject to your profile and privacy settings, any User Content that you make public is searchable by other Users. If you remove information that you posted to the Service, copies remain viewable in cached and archived pages of the Service, or if other Users have copied or saved that information.

For example, you may install a third-party document sharing app in order to store, share and edit content through our Service. These third-party apps are not controlled by us, and this privacy policy does not cover how third-party apps use your information. If you object to information about you being shared with these third parties, do not install the app.

davidji inc. will also share your information with a third party in circumstances where we sell, divest or transfer davidji inc. (including any shares in davidji inc.), or any combination of its products, services, assets and/or businesses to a third party. Information such as customer names and email addresses, User Content and other user information related to the Service may be among the items sold or otherwise transferred in these types of transactions. We will also sell, assign or otherwise transfer such information in the event of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganisations, liquidations, similar transactions or proceedings involving all or a portion of davidji inc.. We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties.

  1. Ads on davidji inc.

We may share certain information such as your location, browser and cookie data and other data relating to your use of our Service with our business partners to deliver personalized advertisements (“ads”) that may be of interest to you. Please see our Cookies Policy for more information. davidji inc. may allow third-party ad servers or ad networks to serve personalized advertisements either on the Service or on third party websites, including Facebook and Google. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, these personalized ads and ad links, and will automatically receive your IP address when they do so. They may also use other technologies (such as cookies, JavaScript, device identifiers, location data, and clear gifs, see above) to compile information about your browser’s or device’s visits and usage patterns on the Service, and to measure the effectiveness of their ads and to personalize the advertising content. davidji inc. does not sell, rent, or share the information we collect directly from you or about you from third parties with these third-party ad servers or ad networks for such parties’ own marketing purposes.

Please note that an advertiser may ask davidji inc. to show an ad to a certain audience of Users (e.g., based on demographics or other interests). In that situation, davidji inc. determines the target audience and davidji inc. serves the advertising to that audience and only provides anonymous aggregated data to the advertiser. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.

The davidji inc. Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers or contact such advertisers for more information.

  1. How we transfer, store and protect your data

Your information collected through the Service will be stored and processed in the United States, and any other country in which davidji inc. or its subsidiaries, affiliates or service providers maintain facilities. davidji inc. transfers information that we collect about you, including personal information, to affiliated entities, and to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. As a result, we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, [and you consent to the transfer of information to the U.S. or any other country in which davidji inc. or its parent, subsidiaries, affiliates or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

davidji inc. cares about the security of your information, and uses appropriate safeguards to preserve the integrity and security of all information collected through the Service. To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from davidji inc., at all times. However, davidji inc. cannot ensure or warrant the security of any information you transmit to davidji inc. or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. Your privacy settings may also be affected by changes to the functionality of third party sites and services that you add to the davidji inc. Service, such as social networks. davidji inc. is not responsible for the functionality or security measures of any third party.

Summary: We care about the safety of your data and, have implemented industry recognized measures to protect it, but unfortunately we can’t guarantee that nothing bad will ever happen to it. (A troop of rabid baboons springs to mind).

In the event that any information under our control is compromised as a result of a breach of security, davidji inc. will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

(a) You control your account information and settings

You may update your account information by logging into your account and changing your profile settings. You can also stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests.

Depending on your type of device, it may not be possible to delete or disable tracking mechanisms on your mobile device. Note that disabling cookies and/or other tracking tools prevents davidji inc. or its business partners from tracking your browser’s activities in relation to the Service, and for use in targeted advertising activities by davidji inc., including via third parties’ websites. However, doing so may disable many of the features available through the Service. Following termination or deactivation of your User account, davidji inc. will retain your profile information and User Content for a commercially reasonable time, and for as long as we have a valid purpose to do so. In particular, davidji inc. will retain your information for the purpose of complying with its legal and audit obligations, and for backup and archival purposes.

We are not responsible for the practices employed by websites or services linked to or from the Service, including the information or content contained therein. Please remember that when you use a link to go from the Service to another website, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible for and we do not exercise control over any third-parties that you authorize to access your User Content.
